What is the 'rule of law'?

The RULE OF LAW is a foundational principle of American democracy meaning that EVERYONE must follow the law — including the government, politicians, judges, and all citizens. No one is above the law. Acceptable USCIS answers include: 'Everyone must follow the law'; 'Leaders must obey the law'; 'Government must obey the law'; 'No one is above the law.' The rule of law contrasts with rule by individuals, where powerful leaders could make decisions based on personal preference or whim rather than established laws. The American founding was deeply shaped by this principle — one of the colonists' grievances against King George III was that he violated the rule of law by imposing taxes and penalties without colonial representation. Key implications: EQUAL APPLICATION: the same laws apply to all people, regardless of wealth, status, or power; DUE PROCESS: people cannot be punished without a fair legal process; ACCOUNTABILITY: government officials who break the law can face consequences; TRANSPARENCY: laws must be publicly known so people can follow them. In practice, the Constitution is the supreme law, and all other laws must conform to it. The courts (especially the Supreme Court) have the role of interpreting laws and ensuring they comply with the Constitution.
